Wikileaks’ Julian Assange ‘would be denied justice’

One of the arguments Mr Assange’s lawyers will raise concerns what is known as “double” or “dual criminality”. this principle ensures that no one is extradited unless the allegations against them from the requesting state, amount to a criminal offence in English law. 

His lawyers will argue that the first three allegations which cover unlawful coercion and sexual molestation do not constitute an offence under English law. 

The equivalent offence would be sexual assault, which requires a lack of consent. it will be argued that the arrest warrant doesn’t allege a lack of consent. 

Double criminality, however, doesn’t apply in the case of the fourth allegation, rape. 

This is one of the list of offences under the European Arrest Warrant framework where the extraditing country has simply to tick a box. 

Mr Assange’s lawyers will seek to argue double criminality here by reference to European law, but it may prove a difficult argument to win. 

He said front-page articles had described his client as a coward for refusing to return to Sweden. 

“There’s a danger this kind of media campaign, media vilification, will prejudice this secret trial,” he told the court. 

He said Swedish rape trials were regularly held behind closed doors and unless the press were allowed in court, his client would not receive a fair trial. 

He also attacked the conditions Mr Assange could be held in if extradited to Sweden, saying the remand prison in Gothenburg had been criticised for its treatment of foreign prisoners. 

But Clare Montgomery QC, representing the Swedish authorities, told the court rape is one of 32 offences that warrants extradition. 

She argued that the Australian must face charges of rape and sexual molestation under Swedish law, following the accusations by two women. 

She said he was accused of having sex with one of the women without a condom, despite her saying she would only consent if he wore one. 

The other woman’s claims implicitly suggested a lack of consent, she added. 

She said: “Mr Assange, by using violence, forced miss A to endure him restricting her freedom of movement, taking hold of her arms, forcefully spreading her legs and lying on top of her.” 

“Violently forcing yourself on someone and causing them to endure your lying on top of them can only be understood as violent, unlawful coercion, as action taken without… consent.”

She also denied Swedish prosecutor Ms Nye was not authorised to issue the arrest warrant and said Mr Assange was wanted for prosecution not merely interrogation.

The whistle-blowing website has been used to publish leaked US diplomatic cables, as well as other sensitive material from governments and high-profile organisations.

Mr Assange arrived at court under an intense media spotlight, and supported by a number of high-profile campaigners including Bianca Jagger, Jemima Khan and veteran politician Tony Benn.

The Australian had his bail conditions amended so he could leave his adopted home in Norfolk to spend the night in Paddington, west London.

Several witnesses are expected to be called to court on Tuesday, and district judge Howard Riddle may yet reserve his judgement to a later date.

Mr Assange was released on bail by a High Court judge just before Christmas after spending nine days in Wandsworth prison.

He denies sexually assaulting two female supporters during a visit to Stockholm in August and claims the inquiry is politically motivated.

The extradition hearing is expected to last two days.

Michael Moore Sues Harvey and Bob Weinstein

Documentary filmmaker Michael Moore filed a lawsuit Monday against Harvey and Bob Weinstein, claiming the pair failed to pay him $2.7 million in profits from his 2004 film, Farenheit 9/11.

The lawsuit maintains that the Fellowship Adventure Group, set up by the Weinstein brothers in partnership with Lionsgate and IFC Films, promised Moore a 50/50 split of the film’s profits.

According to the Los Angeles Times, the suit accuses the fellowship of engaging in “bogus accounting methods” and “substantial irregularities in the accounting of the film” that resulted in Moore receiving less than his due share in profits.

However, when contacted by Entertainment Weekly, the Weinstein’s lawyer, Bert Fields, was very outspoken in response to the lawsuit. He noted that Moore has already received upwards of $20 million for the film, and “he’s not entitled to another dime.”

He also called the allegations of suspicious accounting methods “absolute baloney.”

Moore remains confident in his assertions, though, and even maintains the possibility that he will seek further damages in addition to the $2.7 million once a complete audit is conducted.

So Michael Moore, about whose rape apologia re: the allegations against Assange I first wrote yesterday, was on Keith Olbermann’s show last night, and he doubled down on dismissing the sexual assault charges against Assange, calling them “hooey” and willfully misrepresenting that of which he’s been accused.

[Transcript below.]
Moore asserts that the basis of the charge is that “his condom broke during consensual sex.” That is patently false. Michael Moore is a literate and intelligent man who can surely discern the difference between “his condom broke during consensual sex” and “Assange was alleged to have ‘forcefully’ held her arms and used his bodyweight to hold her down [to "have sex" with her] without using a condom, when it was her ‘express wish’ that one should be used.” In the second case, Assange is alleged to have “had sex” with a woman without a condom while she was sleeping, which cannot possibly be considered consensual sex.

I don’t guess I need to point out the bitter irony of a man championing Julian Assange for exposing hidden truths about powerful governments, and masking the truth of the allegations against Assange in the process.

I know—Maude help me, I know—that governments and corporations use terrible and unethical tactics to discredit whistleblowers and critics. but I wasn’t born yesterday, either. and when around 12% of men (pdf) have, by their own admission, committed sexual assault or rape, it’s not remotely difficult to imagine that rape charges are not routinely invented to use against powerful men, but simply paid attention to when politically expedient.

Assange is entitled to bail, and he is entitled to a fair hearing on the allegations. That is an argument that can be made (like I just did) without any hint of victim-blaming.

Or any mendacious attempts to conceal the truth.

Address that.

Moore: That’s the thing. He hasn’t been charged. They’ve brought no criminal charges against him. they want to talk to him about, about— this whole thing stinks to the high heavens. I gotta tell ya. I mean, I—I wasn’t born yesterday, but I [laughs]— I’ve seen this enough times where governments and corporations go after individuals— Geez, wasn’t I— I think I was just on your show a couple of weeks ago talking about this—

Olbermann: Uh-huh!

Moore: —with my film and the health care industry. they go after people with this kind of lie and smear. Daniel Ellsberg told you about it last week on how they went after him. this is— We’ve seen this before. now, his guilt or innocence of this— I mean, what he said they did— [grinning] and the lawyer said this today in court in London—that what they say he did and the charge is his [rolls eyes] condom broke during consensual sex.

Olbermann: Mm-hmm.

Moore: That is not a crime in Britain, and so they’re making the point how can we—how can we extradite him over this? this is all a bunch of hooey as far as I’m concerned! and, and the man at least has a right to be out of prison while awaiting the hearing, and I believe that, that, uh—and this is why I participate in it; this is why I put up a chunk of the bail money, and, um, you know, I’m proud, proud to do it because I think this man and what he’s doing, and what his group is doing, is going to save lives.
